We have the right to use anonymized data and statistics extracted from access and use by you and authorized users of the purchased services in any manner necessary to improve the Jostle Services for the benefit of all subscribers. 1.9 Huddle shall ensure that Huddle Personnel, which processes protected data, has signed agreements obliging it to treat the protected data confidentially and to take all appropriate measures to ensure the reliability of the processing of the data protected by Huddle Personnel. 1.4 "Huddle End User License Agreement" means the online agreement that governs the use of the Services by users other than the Subscriber`s employees and representatives, while understanding and agreeing that the use of the Services by the Subscriber`s staff and representative will instead be subject to the terms of this Agreement. 2.4 All content remains the exclusive property of the subscriber or the property of its rightful owner. Huddle assumes no responsibility for this content. By downloading third party content, Subscriber represents and warrants that it has obtained all licenses, permissions, consents and agreements necessary for the lawful use of such content by Huddle and third parties in accordance with this Agreement and for huddle to provide the Services. Subscriber acknowledges and agrees that Huddle does not control the content posted by users and does not guarantee the accuracy, integrity or quality of such content. Subscriber agrees that Subscriber evaluates the use of third party content and assumes all risks, including reliance on the accuracy, completeness or usefulness of such content. In no event shall Huddle be liable for any third party content, including, but not limited to, errors or omissions in third party content, loss or damage of any kind resulting from the use of third party content posted, sent, transmitted or otherwise made available by email through the Service or Site. 14.2 Unless otherwise agreed, the arbitration shall take place either in the County of The Subscriber, principal residence, or in New York County, New York.
